Rules to Adopting Your Partner's Children

If you are in a relationship with someone, you might decide at one point that their children are children that you would like to have legal custody over. If you have decided that you want to adopt your partner's children, there are several things that you should be aware of before you begin the process.

 

First of all, you should know that the rules for adopting a partner's child vary from state to state. So before you make any huge decisions, you should check with your state for its rules and regulations. Secondly, you need to know that in most states you cannot adopt a child unless both of that child's parents agree to it. That means that the child that you want to adopt must be able to be adopted.  Your partner must declare that they want you to be the other parent to their child. Also, the other parent of that child must also agree to this. If the other parent of your partner's child is dead, you can legally adopt that child as long as your partner agrees to it. If the other parent is living, they will need to actually give up custody and give up all of their parental rights before you can adopt that child.

 

If you have decided that you want to adopt your partner's children, there are several things that you should know. First of all, this means that you are going to be that child's parent. If you and your partner should break up and no longer be together you are still going to be the parent of that child. Likewise, if your partner dies, you will be the sole custodian of that child. So, this is not something you should decide to do unless you are completely sure that you want to make a lifelong commitment to that child. Remember that you are doing what you feel is best for the child, so you should make sure that you take the child's feelings into consideration. If the child has had another parent that they are close to, who has died, they might feel spiteful towards you if you adopt them too soon. They might feel like you are taking their deceased parent's place. For these reasons, you should be careful to make sure that you are doing what is not only in the best interest of everyone involved, but that you are doing what everyone wants you to do.
